Hij was verbonden aan de Vakgroep grondslagen en geschiedenis van het recht van de Universiteit Gent en speelde decennia lang als publieke intellectueel en ethicus een belangrijke rol in maatschappelijke en ethische debatten in Vlaanderen, België, Nederland, maar ook daarbuiten. In dit boek is een brede selectie van ingeleide teksten van hem opgenomen. Het verschijnt parallel met een (dubbel)nummer van het tijdschrift 'Ethiek en Maatschappij' - een tijdschrift door Koen Raes (...) in 1998 opgericht en waarvan hij tot recent ook de gedreven hoofdredacteur van was. Uit de hier door Gily Coene verzamelde teksten en uit de inleidingen erop blijkt overduidelijk hoe scherp en helder Koen Raes complexe maatschappelijk-ethische problemen en thema's in kaart kon brengen en hier een gefundeerde positie over kon ontwikkelen. An examination of the studies of the French historian of religion Jean Delumeau on the subject of ‘angst’ and awareness of guilt as a collective mode of being, characteristic of Europeans from the 13th to the 18th century, will not only provide the reader with a nuanced picture of the influence of the so-called Renaissance and Reform Movement on the liberation of the human person, but he or she will also find it difficult to resist the temptation to draw parallels (...) with current explanations for the present day increase in feelings of insecurity and ‘angst’.Both then and now the collective ‘angst’ resulting from epidemic, war, famine and natural disaster vented themselves against ‘outsiders’, those who were different; foreigners witches, gypsies, heretics, vagabonds, the insane and the crippled all became targets. Just as people today try to discern devilish plans afoot in a world stricken by AIDS, environmental and health dangers, by growing unemployment, fundamentalism and migration, and by plans intent on undermining Western civilisation as we know it, so also then people found it easy to identify demons in the ‘other’, disguised Antichrists and Satans whose sole purpose was to undermine Christian culture. In those days people tried to avert the danger by attempting to force Muslims by government decree and Cathars by the Inquisition to embrace the true faith of Christians. Today we try to do the same by submitting foreigners to an ever narrowing concept of integration.In pre-modern culture, just as today, subjective feelings of insecurity were disproportional to objective insecurity, and although the chances of falling victim to epidemic, war or criminal acts were much greater among the lower social classes, protests of insecurity from among the better situated classes, tended to set the tone, as they continue to do today.Two aspects of Delumeau’s evocation of the culture of ‘angst’ are particularly striking. Firstly, one becomes aware of the quasi evident moralising with which people tackled the most diverse social phenomena. Signs of God’s wrath were to be found everywhere as moral warnings. Difference and alterity was immediately understood in terms of godlessness, decline, guilt, sin, unworthiness, vice, wickedness or cunning. The Christian culture was in its very core a culture of meaning in which everything, as a matter of course, acquired a moral significance. In this regard, the advent of Protestantism did not essentially change matters: morality shifted towards individual responsibility, but its worldview did not become less moralising as a result. Actually, it became even more moralising. Secondly, one becomes aware of the sustained efforts of the Church to spread and intensify the culture of ‘angst’ and to view everything from the perspective of the contemptus mundi, vitae et homini. Every form of human joy, delight or pleasure was condemned as a manifestation of insufficiency in one’s fear of God. Although the world was never to become the ‘vale of tears’ of which the clerical authorities dreamed, ‘angst’ and fear were nevertheless an essential feature of the condition humaine of the time and the dominant religious cultural expressions of the day were solely directed towards the maintenance of such a culture of ‘angst’. In teaching professional ethics to students of a particular profession , one must start from the actions which are essential within the professional practice which is central to a particular academic training. Although universities do not, as such, provide particular profession-oriented trainings, but are, in the main, inspired by scientific research, most curricula are nevertheless clearly linked to professional careers. First and foremost, we should elucidate the values at stake from an internal perspective, from within the human — and thus (...) socioculturally determined practice which is itself oriented toward particular values.Any profession is situated in a complex field of relationships between its axiological orientation , its etiological interpretation and its therapeutic solutions .Any profession involves a collection — or a system — of problem-solving activities. They all have particular definitions of their problems, their goals and their remedies or solutions, and what is problematic, an aim or a remedy within one particular profession, may not be defined as problematic, an aim or a remedy within another profession. What is more, it is not at all the case that, within most professions, there exists a general consensus about its axiology, its etiology and its therapy. The reasons why this is the case should be the subject of scrutiny as well. (shrink)

What is the point of language? If we begin with that abstract question, we may be tempted towards a high-minded answer: “People say things to get other people to come to know things that they didn't know before” (Stalnaker, 2002, 703). The point is truth, knowledge, communication. If we begin with a concrete question, “What has language to do with race?” we find a different point: to attack, spread hatred, create racial hierarchy. The mere practice of racial categorization is controversial: (...) are race terms natural or social kind terms? What does categorization do to the categorized? (Outlaw, 1990; Omi and Winant, 1994; Appiah, 1996; Andreason, 1998; Kitcher, 1999; Zack, 2002; Haslanger, 2008; Glasgow, 2009). But there is worse than mere categorization to contend with. (shrink)

Civil society organizations (CSOs) have significantly impacted on the politics of health research and the field of bioethics. In the globalHIVepidemic,CSOs have served a pivotal stakeholder role. The dire need for development of new prevention technologies has raised critical challenges for the ethical engagement of community stakeholders inHIVresearch. This study explored the perspectives ofCSOrepresentatives involved inHIVprevention trials (HPTs) on the impact of premature trial closures on stakeholder engagement. Fourteen respondents fromSouthAfrican and internationalCSOs representing activist and advocacy groups, community mobilisation initiatives, (...) and human and legal rights groups were purposively sampled based on involvement inHPTs. Interviews were conducted fromFebruary‐May 2010. Descriptive analysis was undertaken across interviews and key themes were developed inductively.CSOrepresentatives largely described positive outcomes of recent microbicide andHIVvaccine trial terminations, particularly inSouthAfrica, which they attributed to improvements in stakeholder engagement. Ongoing challenges to community engagement included the need for principled justifications for selective stakeholder engagement at strategic time‐points, as well as the need for legitimate alternatives toCABs as mechanisms for engagement. How are masculinity and nationalism intertwined? This question has received scant theoretical attention, and existing theories tend to focus on their shared ideals and are embedded in a heteronormative, homophobic, and patriarchal framework. Such views imply a static relationship between the two phenomena and are incompatible with the recent phenomenon of homonationalism and the incorporation of some homosexual bodies within the nation. Addressing this theoretical gap, this article develops a more holistic framework of the relationship between nationalism and masculinity. Drawing (...) on relational sociology, it conceptualises nationalism as competing masculinities. It argues that the link between masculinities and nationalism is not found in their overlapping substantive ideals, but rather that the two phenomena are co-constructed through their overlapping Othering processes. The proposed theoretical framework does not only provide a more dynamic understanding of the link between masculinity and nationalism, but it also helps to overcome the apparent duality between homonationalism and heteronationalism. It is shown that both phenomena are in fact two sides of the same coin, with the main difference between them being the location of homophobia as a technology of Othering within different types of Self/Other relations. Overall, the article provides an analytical tool that allows for the contextualisation and understanding of seemingly contradictory features of nationalism and its relationship to masculinity. We defend the view of some feminist writers that the notion of silencing has to be taken seriously in discussions of free speech. We assume that what ought to be meant by ‘speech’, in the context ‘free speech’, is whatever it is that a correct justification of the right to free speech justifies one in protecting. And we argue that what one ought to mean includes illocution, in the sense of J.L. Austin.

The distinction at the heart of Kant's philosophy is a metaphysical distinction: things in themselves are substances, bearers of intrinsic properties; phenomena are relational properties of substances. Kant says that things as we know them are composed "entirely of relations", by which he means forces. Kant's claim that we have no knowledge of things in themselves is not idealism, but humility: we have no knowledge of the intrinsic properties of substances. Kant has an empiricist starting-point. Human beings are receptive creatures. (...) We must be affected by the things of which we come to have knowledge. Kant believes that humility follows from this fact of receptivity. Humility does follow from receptivity, once a further premise is supplied. Kant believes that relational properties, causal powers in particular, are not reducible to intrinsic properties, and that intrinsic properties are therefore causally inert. Receptivity implies that we can have knowledge only of what can affect us. Irreducibility implies, in Kant's view, that intrinsic properties cannot affect us. Humility follows from these. This interpretation finds support in a range of critical and pre-critical writings, but there is a special focus on an early anti-Leibnizian argument for irreducibility that has considerable philosophical merit. One advantage of this interpretation is that the following famous contradiction is dissolved: things in themselves exist, and are the causes of phenomena, and we have no knowledge of them as they are in themselves. Moreover Kant's scientific realism, surprising on an idealist interpretation, makes sense. It does not conflict with Kant's claim that he makes all the qualities secondary--he means that he makes them powers, or in Locke's terms, tertiary qualities. Kant's "primary"/secondary quality distinction is superior to widely accepted alternatives, and his application of the irreducibility argument to the primary qualities challenges some current orthodoxies. Kant's commitment to the unobservables of science is permitted by his understanding of receptivity: we can have knowledge of anything that can affect us. Kant's scientific realism, and his humility, thus have a common source. (shrink)

This book presents a thorough and critical evaluation of the monetary and financial system prevalent in Western economies. Further, it seeks to explain why this system so often leads to financial crises and why they have been dealt with unsatisfactorily in the past. In order to provide answers to these questions, the book investigates the monetary and financial system from a multidisciplinary perspective, with a strong focus on the ethical value choices which throughout history have shaped the monetary and financial (...) legal system. In the closing chapters, the book also advances a detailed proposal for a New Global Monetary Order, one based on altruism, as an alternative to the neoliberal values dominant today. (shrink)

ABSTRACTThe massive influx of refugees into Europe in the past few years has given rise to different kinds of challenges among which is the challenge to successfully communicate with newly arrived immigrants. In this article, we will focus on the public service provision sector where quality of service is to a large extent determined by the capability of a service provider and his or her “client” to understand one another. The article centres on a study involving public organisations providing asylum (...) services or healthcare services in the multilingual and multicultural city of Brussels. Several interviews were conducted to gain insight into the communication problems such organisations face, as well as their communication requirements and solutions when providing services to people of different linguistic and cultural backgrounds. We will focus on the types of bridging functions commonly deployed by these organisations in multilingual service encounters and on the motivations for using them. In a... (shrink)

What could a social-justice oriented, feminist data studies look like? The current datalogical turn foregrounds the digital datafication of everyday life, increasing algorithmic processing and data as an emergent regime of power/knowledge. Scholars celebrate the politics of big data knowledge production for its omnipotent objectivity or dismiss it outright as data fundamentalism that may lead to methodological genocide. In this feminist and postcolonial intervention into gender-, race- and geography-blind ‘big data’ ideologies, I call for ethical, anti-oppressive digital data-driven research in (...) the social sciences and humanities. I argue that a reflexive data scholarship can emerge from the reintegration of feminist and postcolonial science studies and ethics of care ideals. Although it is not a panacea for all ails of data mining, I offer a road map for an alternative data-analysis practice that is more power-sensitive and accountable. By incorporating a people-centric and context-aware perspective that acknowledges relationships of dependency, reflects on temptations, and scrutinises benefits and harm, an ‘asymmetrically reciprocal’ (Young, 1997) research encounter may be achieved. I bring this perspective to bear on experiences of a two-year research project with eighty-four young Londoners on digital identities and living in a highly diverse city. I align awareness of uneven relations of power and knowledge with the messy relation of dependency between human and non-human actors in data analysis. This framework productively recognises that digital data cannot be expected to speak for itself, that data do not emerge from a vacuum, and that isolated data patterns cannot be the end-goal of a situated and reflexive research endeavor. Data-driven research, in turn, shows the urgency for renewed feminist ethical reflection on how digital mediation impacts upon responsibility, intersectional power relations, human subjectivity and the autonomy of research participants over their own data. A first in English, this book engages with the ways in which Hegel and Sartre answer the difficult questions: What is it to be human? What place do we have in the world? How should we live? What can we be?

If, as many suppose, pornography changes people, a question arises as to how.1 One answer to this question offers a grand and noble vision. Inspired by the idea that pornography is speech, and inspired by a certain liberal ideal about the point of speech in political life, some theorists say that pornography contributes to that liberal ideal: pornography, even at its most violent and misogynistic, and even at its most harmful, is political speech that aims to express certain views about (...) the good life, 2aims to persuade its consumers of a certain political point of view—and to some extent succeeds in persuading them. Ronald Dworkin suggests that the pornographer contributes to the ‘moral environment, by expressing his political or social convictions or tastes or prejudices informally’, that pornography ‘seeks to deliver’ a ‘message’ , that it reflects the ‘opinion’ that ‘women are submissive, or enjoy being dominated, or should be treated as if they did’, that it is comparable to speech ‘advocating that women occupy inferior roles’.3 Pornography on this view is political speech that aims to persuade its listeners of the truth of certain ideas about women, and of course ‘the government must leave to the people the evaluation of ideas’.4 Another answer offers a vision that is not grand and noble, but thoroughly reductive. Pornography is not politically persuasive speech, but speech that works by a process of psychological conditioning. This view seems common enough in the social science literature. Consider, for example, this description of an early experiment, from a time that pre-dates contemporary political debate. (shrink)

This chapter sets forth a general theory of gender stratification. While both biological and ideological variables are taken into account, the emphasis is structural: It is proposed that the major independent variable affecting sexual inequality is each sex's economic power, understood as relative control over the means of production and allocation of surplus. For women, relative economic power is seen as varying-and not always in the same direction-at a variety of micro- and macrolevels, ranging from the household to the state. (...) A series of propositions links the antecedents of women's relative economic power, the interrelationship between economic and other forms of power, and the forms of privilege and opportunity into which each gender can translate its relative power. The discussion about the impact of agricultural biotechnology on Africa is deeply divided and contains widely diverging claims about the impact of biotechnology on African farmers. Building upon literature on the ‘good farmer’ that highlights that farmers identities are an important factor in explaining the success or failure of agricultural change, we argue that the identity of the farmer is an undervalued yet crucial aspect for understanding the debate about the impact of agricultural biotechnology on African farmers. In this article (...) we therefore investigate what farmers’ identities are implicated in the arguments about the impact of biotechnology on African farmers. We aim to identify the main fault lines in different accounts of the African biotechnology farmer by analysing the identities ascribed to them in two prominent cases of controversy: the debates at the 2002 World Summit on Sustainable Development in Johannesburg and the discussion about the impact of biotechnology on smallholder farmers in the Makhathini flats in KwaZulu Natal, South Africa. Our findings demonstrate that arguments about biotechnology are informed by diverging conceptions of who the African farmer is, what is important for the African farmer, and what role the African farmer has in relation to agricultural biotechnology. These findings remain relevant for current discussions on gene editing technologies like CRISPR-Cas. Openly discussing these different views on the identity of smallholder farmers is crucial for moving forward in the biotechnology controversy and can inform future attempts to elicit the farmer’s voice. Synthetic biology, as an engineering approach to biological systems, has the potential to disruptively innovate the development of vaccines, therapeutics, and diagnostics. Data accessibility and differences in data-usage capabilities are important factors in shaping this innovation landscape. In this paper, the data that underpin synthetic biology responses to the COVID-19 pandemic are analyzed as positional information goods—goods whose value depends on exclusivity. The positionality of biological data impacts the ability to guide innovations toward societally preferred goals. From both an ethical (...) and economic point of view, positionality can lead to suboptimal as well as beneficial situations. When aiming for responsible innovation (i.e. embedding societal deliberation in the innovation process), it is important to consider hurdles and facilitators in data access and use. Central governance and knowledge commons provide routes to mitigate the negative effects of data positionality. (shrink)

This book examines how legal systems and mechanisms give shape to the capitalist economic system. In this regard, it focuses on the most important of these systems, such as monetary and financial law, company law, fiscality, contract and labour law. Further, the book provides a thorough analysis of the underlying ethical values of said legal systems and mechanisms. It also gives an overview of several potentially devastating related effects, such as poverty, the increasing polarisation between rich and poor, climate change, (...) and mounting debts at both the public and private level. The book concludes by presenting proposals for change. Given its critical analysis of legal systems and mechanisms in connection with the value choices dictated by economic ideologies, the book will be of particular interest to legal and economic academics, researchers and students, but also to policymakers, and, more generally, to anyone with a genuine concern for how the socio-economic order will evolve. We investigate empirically whether framing in general, and the use of Simplifying Models as a framing tool in particular, has an effect on the way topics are cognitively construed. Existing studies on framing in linguistics have either been theoretical or descriptive. Going beyond such methodologically simple approaches, we use a more rigid test design involving the use of a control group, the construction of test conditions in which different Simplifying Models constitute the major source of variation, the inclusion of independent (...) variables like age and prior knowledge of the subjects, and the use of linear and logistic regression analysis. Our results show that our more rigid methodological approach yields a more reliable image of the effect of Simplifying Models on the way in which people deal with information on a complex topic like sustainable food production. Fleshing out these effects further may in time lead to a better informed construction of communication on complex social topics. (shrink)

Accounts and analyses of the formation of scholarly and scientific communities in the early modern period by means of memory and collective identity.

Kant argued that we have no knowledge of things in themselves, no knowledge of the intrinsic properties of things, a thesis that is not idealism but epistemic humility. David Lewis agrees (in 'Ramseyan Humility'), but for Ramseyan reasons rather than Kantian. I compare the doctrines of Ramseyan and Kantian humility, and argue that Lewis's contextualist strategy for rescuing knowledge from the sceptic (proposed elsewhere) should also rescue knowledge of things in themselves. The rescue would not be complete: for knowledge of (...) things in themselves would remain elusive. (shrink)

Whole brain emulation aims to re-implement functions of a mind in another computational substrate with the precision needed to predict the natural development of active states in as much as the influence of random processes allows. Furthermore, brain emulation does not present a possible model of a function, but rather presents the actual implementation of that function, based on the details of the circuitry of a specific brain. We introduce a notation for the representations of mind state, mind transition functions (...) and transition update functions, for which elements and their relations must be quantified in accordance with measurements in the biological substrate. To discover the limits of significance in terms of the temporal and spatial resolution of measurements, we point out the importance of brain region and task specific constraints, as well as the importance of in-vivo measurements. Quantum physics is believed to be the fundamental theory underlying our understanding of the physical universe. However, it is based on concepts and principles that have always been difficult to understand and controversial in their interpretation. This book aims to explain these issues using a minimum of technical language and mathematics. After a brief introduction to the ideas of quantum physics, the problems of interpretation are identified and explained. The rest of the book surveys, describes and criticises a range of (...) suggestions that have been made with the aim of resolving these problems; these include the traditional, or 'Copenhagen' interpretation, the possible role of the conscious mind in measurement, and the postulate of parallel universes. This new edition has been revised throughout to take into account developments in this field over the past fifteen years, including the idea of 'consistent histories' to which a completely new chapter is devoted. ABSTRACT This article offers the first comprehensive reconstruction of Hannah Arendt's contribution to the venerable chapter of modern intellectual history known as ‘the Idea of the university.’ Arendt first jotted down her thoughts on this topic in a 1946 letter to Karl Jaspers, in response to the manuscript of his then forthcoming book Die Idee der Universität. She later revisited the topic in three different moments. We trace these three sequels back to three contemporary political crises to which she bore (...) witness: (i) the problem of Arab-Jewish relations following the founding of Israel, (ii) the suppression of freedom of speech during the McCarthy era, and (iii) the American student protest movement of the 1960s. At the heart of Arendt's idea of the university is a tension that she never managed to resolve: namely, that between the image of the university as a nonconformist community ethically committed to the transformation of the social world, on the one hand, and the image of the university as a secluded sanctuary of contemplative freedom dedicated to the disinterested pursuit of truth, on the other. Whereas the first puts her at odds with Jaspers and is predominant in the early reflections, the second pulls her closer to him and becomes prominent in the later ones. More broadly, the article contends that the history of Arendt's reflections on the university bears on our understanding of the evolution of her political thought. (shrink)

This article contributes to the debate about how regulatory science for agricultural technologies can be ‘opened up’ for a more diverse set of concerns and knowledges. The article focuses on the regulation of ‘socio-economic considerations’ for genetically modified organisms. While numerous countries have declared their intent to include these considerations in biotechnology decision-making, it is currently unclear both what counts as a socio-economic consideration and how such considerations should be assessed. This article provides greater clarity about how socio-economic considerations can (...) be included in regulations by drawing upon the experience of two countries whose efforts in this field are particularly advanced: Kenya and South Africa. Based on extensive fieldwork, this article identifies the contours of an emerging regulatory regime by presenting two practice-based models for including socio-economic considerations in biotechnology decision-making. Whereas Kenya has taken a bottom-up process prior to assessing the first technologies and strongly emphasises scientific expertise, South Africa has instead established regulatory standards in an ad hoc fashion on a case-to-case basis, with a less prominent role for scientific evidence. The discussion of the distinct characteristics and tensions of both models provides insight into two potential pathways for including socio-economic considerations in the regulation of agricultural technologies. The aim of this exploratory cross-sectional study was to examine the associations among relationship status, identity processes, and self-construals among Polish young adults. The theoretical framework of the study consisted of Erikson’s psychosocial theory of human development, the dual-cycle model of identity formation, and the concept of independent and interdependent self-construals. A total of 291 university students aged 20-25 completed the Dimensions of Identity Development Scale and Self-Construal Scale. Results showed that single individuals scored higher on exploration in breadth, exploration (...) in depth, and ruminative exploration, and lower on commitment making and identification with commitment than did partnered individuals. Further, single and partnered individuals did not differ in the area of independent and interdependent self-construals. Discriminant function analysis revealed that especially ruminative exploration and exploration in breadth were important variables for discriminating single from partnered status. (shrink)
